This document explains the legal framework of our telemedicine services and serves to obtain your informed consent.
Professional Secrecy and Disclosure Authorization (Art. 321 SCC)
Physicians and pharmacists are bound by professional secrecy pursuant to Art. 321 of the Swiss Criminal Code. This means that they generally may not disclose secrets entrusted to them in the course of their profession.
According to Art. 321 para. 2 SCC, disclosure is permissible if it occurs 'with the consent of the entitled person.' Your consent in this document authorizes the medical professionals involved in your treatment to share information necessary for your care with each other.
Specifically, this covers the exchange of health information between orva (in formation), the treating physicians, and the partner pharmacy. Details are set out in our Terms & Conditions.
Formula Magistralis (Art. 9 para. 2 lit. a TPA)
The Swiss Therapeutic Products Act distinguishes between authorized finished medicinal products and authorization-exempt individual preparations. According to Art. 9 para. 2 lit. a TPA, medicinal products 'manufactured in a public pharmacy or hospital pharmacy in execution of a medical prescription for a specific person' do not require authorization. These are referred to as 'formula magistralis.'
A formula magistralis is not reviewed by Swissmedic regarding the safety, efficacy, or quality of this specific individual preparation. Professional responsibility for the prescription lies with the prescribing physician; for proper compounding, with the executing pharmacy.
You have a duty to cooperate: Before starting treatment, you should inform yourself about the pharmacological properties, possible side effects, and interactions of the prescribed active ingredients. Our drug directory provides detailed information for this purpose.
Your Informed Consent
By confirming this document, you bindingly declare:
- You have read and understood this disclosure document as well as the information provided by the treating physician.
- You had the opportunity to ask the treating physician questions and received satisfactory answers.
- Therapeutic alternatives and risks associated with the treatment have been explained to you.
- You grant the participating medical professionals consent pursuant to Art. 321 para. 2 SCC to disclose information necessary for your treatment.
- You consent to the prescription and compounding of a formula magistralis pursuant to Art. 9 para. 2 lit. a TPA.
Right to Revoke
This consent may be revoked at any time with effect for the future. Revocation does not affect the lawfulness of processing carried out prior to the revocation. To revoke, please contact legal@orva.ch.
