This document explains the legal framework of our telemedicine services and serves to obtain your informed consent.
Professional Secrecy and Disclosure Authorization (Art. 321 no. 1 SCC)
Physicians and pharmacists are bound by professional secrecy pursuant to Art. 321 no. 1 of the Swiss Criminal Code. This also applies to assistants involved in treatment or service provision.
Your consent in this document authorizes the medical professionals involved in your treatment to exchange the information necessary for your care with each other and with the dispensing partner pharmacy.
orva employees support medical professionals only technically or administratively and only to the extent necessary. They are bound to confidentiality as assistants. Details are set out in our Terms of Use.
Formula Magistralis (Art. 9 para. 2 lit. a TPA)
The Swiss Therapeutic Products Act distinguishes between authorized finished medicinal products and authorization-exempt individual preparations. According to Art. 9 para. 2 lit. a TPA, medicinal products 'manufactured in a public pharmacy or hospital pharmacy in execution of a medical prescription for a specific person' do not require authorization. These are referred to as 'formula magistralis.'
A formula magistralis is not reviewed in advance by Swissmedic regarding the safety, efficacy, or quality of this specific individual preparation. Professional responsibility for the prescription lies with the prescribing physician; responsibility for proper compounding lies with the executing pharmacy.
Before starting treatment, you should inform yourself about the pharmacological properties, possible side effects, contraindications, and interactions of the prescribed active ingredients. Our drug directory provides detailed information; final counseling is provided by the physician during the consultation.
Your Informed Consent
By confirming this document, you bindingly declare:
- You acknowledge that the treatment contract is concluded directly between you and the treating physician. orva acts exclusively as a platform operator and intermediary and is not a party to the treatment relationship.
- You have read and understood this information document and the available information about the active ingredients, including the notice that a formula magistralis is not authorized in advance by Swissmedic.
- You had or will have the opportunity during the medical consultation to ask questions about diagnosis, treatment options, risks, alternatives, and use. Final informed consent to the specific treatment is given to the treating physician.
- You grant the participating medical professionals, partner pharmacies, and necessary assistants consent under Art. 321 no. 1 SCC to disclose the information required for your treatment and consent to the prescription and compounding of a formula magistralis under Art. 9 para. 2 lit. a TPA.
Right to Revoke
This consent may be revoked at any time with effect for the future. Revocation does not affect the lawfulness of processing carried out prior to the revocation. To revoke, please contact legal@orva.ch.
